Job Summary

We are looking for a highly experienced Contracts Department Manager to be responsible for the formation and administration of contracts across megaprojects in Saudi Arabia, you will oversee the entire project lifecycle. This role offers you a once-in-a-lifetime opportunity to be part of developing, creating and delivering three new smart cities in Saudi Arabia – Qiddiya Entertainment City, NEOM, and the Red Sea Project.

As the Contracts Department Manager, you will report directly to the Project Director and be expected to manage workload distribution, execution of work and personnel management within procurement, contract and commercial departments. From start to final contract closure, you will work on pre-qualification, compile of bid requests, receipt of bids, bid evaluation, award, monitoring contractor performance based on conditions of contracts, invoicing and evaluations, amendments, payments, resolution of claims/disputes, and approval of applications for payment.

Working with the PMO, this role involves implementing departmental regulations, practices, policies and procedures to promote best strategies for managing staff governance and their deliverables. Optimizing PMO contract resources for project delivery and actively supporting professional development of staff to ensure they have access to the best available training. In turn, you will provide guidance and assistance to Project Managers and other PMO departments on all contractual matters.

Job Description

  • Review, develop and enforce administrative procedures for practical and economic performance within terms and conditions of the contract and policies approved by the Project Director and client

  • Administer the procurement process – advance review of construction plans and specifications, assist preparation of solicitations, coordinate and schedule pre and post-bid clarification meetings, amendment preparation and contract negotiations for PMO

  • Develop and implement procedures for contract management and administration in line with PMO policy – contribute, influence and improve company policies, when appropriate

  • Directly manage or via contracts department staff, the administration of new and on-going contracts, including monitoring contractor compliance, investigating problems and recommending corrective actions

  • Directly manage or via contracts department staff, the preparation of correspondence and maintain records necessary to ensure effective administration of all contractual matters

  • Administer, review and recommend contract changes, review and settlement of claims, resolution of disputes and contract change negotiations

  • Assist the Project Manager in contract close-out procedures to ensure all terms and conditions of contracts are compiled before final payment to contractors, the release of bonds etc.

  • Make amendments to contractual documents as required

  • Prepare for final approval pre-qualification and selection of contractors

  • Manage the bid evaluation process and make the final recommendation

  • Lead tender negotiations through to final recommendations for approval

  • Ensure all contractual procedures are implemented and maintained

  • Advise and provide governance on contractual and commercial matters, including payments approval

  • Ensure departmental reporting accuracy and on-time delivery

  • Enforce policies relating to Health, Safety and Environmental practices

  • Support teams in forecasting, planning, and executing of multiple projects within the program – coordinate with project control requirements and provide specialized training needed

  • Support initial formalization of contracts and commercial function across the program, work with project support staff to assess capabilities, assign roles and responsibilities, and deploy uniform procedures and practices

  • Support leadership and act as the lead for scope change control, change management, claims management and overall commercial management of major complex projects

  • Manage procurement activities by providing cost and contract specifications for pre-awarded contracts

  • Provide support and monitor commercial risk registers

  • Identify potential claims and pro-actively resolve them with input from stakeholders

  • Provide analysis and forecast for major programs, including CAPEX, OPEX expenditures and requirements.

Minimum Requirements

  • Degree qualified in a relevant discipline, business / finance / scheduling / construction contract law / quantity surveying

  • Minimum 20 years of related work experience in managing contracts departments, with a track record of holding leadership roles across Program Contract Services disciplines

  • Contracts knowledge of FIDIC, NEC3, AIA, DBIA and FAR

  • Working experience within large institutions, developers or governmental agencies while managing design and build types of contracts

  • Solid experience in pricing, contract law, contract drafting, administration and negotiation of change orders, preparing contractual correspondence, budget management, planning and scheduling

  • Expertise in prime contracts management administration, sub-contract formation and administration, execution of office and field policies and procedures and documents relating to a multi-discipline construction program of works

  • Must have a broad general engineering background and previous Middle East project management experience on similar or related project types

  • Technical and administrative knowledge of the wider engineering/construction industry and have direct experience in contracting practices, government and commercial procurement

  • Proficient in using Proliance, Prolog, SAP, Oracle, SharePoint, Aconex, Primavera Contract Manager, Primavera, and Microsoft Office Suites.

Preferred Qualifications

  • Masters or postgraduate degree in Engineering or Construction Management

  • Membership of a Chartered Institution, MICE / MCIOB / MRICS

  • PMP, APM, CMAA or an equivalent accreditation

  • International working experience in the USA, Europe in addition to the Middle East experience
